Is it possible to dump the NES-games (ROMS) from Wii Virtual Console so I can use them on a emulator or my Everdrive?
It's possible, but that won't be any more legal than other simpler ways of dumping games (likely less so, really) and the games are identical* to the ROM images floating around elsewhere.
*some games were modified to have flashing color effects reduced or removed

No. They are allowed to use the file format. I mean accuse of stealing illegal copies of those games.
If they are the copyright holder, or are licensed by the copyright holder, the "color" of the bits don't matter.
We can giggle about it, but the fact of the matter is that it's completely irrelevant from a legal point of view.
What does the header really do? It only tells you the size of the game and (for iNES 1.0) some idea of what kind of hardware the game uses and some other information like mirroring. Nothing you can't determine by yourself by opening up the cartridge and dumping the ROMs.

Yes, but DiskDude is not the proper file format, and if that is in there it would suggest that they did not dump the ROMs themself or use their own copies of the ROM images, but instead used illegal copies, and you can call them a hypocrite.
